Terms of Service

These Terms of Service apply to your use of the Apter website, courses, events, communications, and related services.
Apter is operated by APTER PTY LTD, ABN 31 693 469 368. In these Terms, “Apter”, “we”, “us”, and “our” refer to APTER PTY LTD.
By using this website, registering for a course, applying for an award or funded place, subscribing to our communications, or otherwise engaging with Apter, you agree to these Terms.
1. About Apter
Apter provides professional development courses, workshops, learning experiences, and related services for professionals and organisations working in areas including coastal resilience, climate risk, artificial intelligence, emergency management, energy transitions, and related fields.
Our courses may be delivered in person, online, in hybrid formats, or through custom arrangements with organisations.
2. Use of the website
You may use the Apter website for lawful personal, professional, and organisational purposes.
You must not:
• use the website in a way that disrupts or damages its operation;
• copy, scrape, reproduce, or redistribute website content except as permitted by law or with our written permission;
• submit false, misleading, or unlawful information;
• interfere with any registration, payment, application, or communication system;
• use Apter content or systems for spam, impersonation, fraud, or other misuse.
We may update, suspend, or change the website at any time.
3. Course registrations
A course registration is confirmed when Apter accepts the registration and either:
• payment has been received;
• a valid purchase order has been provided;
• an invoice arrangement has been approved by Apter; or
• Apter has otherwise confirmed the place in writing.
Places may be limited. Apter may close registrations when a course reaches capacity.
You are responsible for ensuring that participant details, billing information, dietary requirements, accessibility needs, and any other relevant information are accurate and provided in time.
4. Pricing, GST, invoices, and purchase orders
Prices are stated in Australian dollars unless otherwise indicated.
Unless stated otherwise, published prices are inclusive of GST.
Apter may accept payment by card, invoice, purchase order, or another approved method. Where invoice or purchase order payment is requested, Apter may require sufficient billing details before confirming a place.
Invoices are payable within 7 days of issue unless Apter agrees otherwise in writing.
If payment is not received by the due date, Apter may follow up, suspend access to course materials, withhold certificates, release a reserved place, or cancel a registration.
Apter may correct pricing errors or invoice errors where necessary. If a material pricing error affects your registration, we will contact you before proceeding.
5. Cancellations, refunds, transfers, and substitutions
We understand that professional commitments change. The following policy applies unless a specific course page or written agreement states otherwise.
Participant cancellations
If you cancel your registration:
• more than 21 days before the course start date, Apter may provide a refund less any non-recoverable transaction fees or committed costs;
• 8 to 21 days before the course start date, Apter may offer a transfer to a future course or a credit, but a refund is not guaranteed;
• 7 days or fewer before the course start date, refunds are generally not available.
Where Apter has already incurred non-refundable costs, including venue, catering, accommodation, travel, materials, or facilitator costs, those costs may be deducted from any refund or credit.
Substitutions
Participant substitutions are usually allowed at no additional cost if you notify Apter before the course starts and the substitute participant is suitable for the course.
Transfers
Apter may allow transfer to another course or cohort where places are available. Any price difference may be payable. Transfers are not guaranteed.
Non-attendance
If a registered participant does not attend and has not arranged a cancellation, substitution, or transfer in advance, no refund is payable.
6. Course changes by Apter
Apter's courses run subject to sufficient enrolment. Apter may cancel or change course dates, venues, speakers, facilitators, format, content, timetable, or delivery mode where reasonably necessary, including where a course does not reach the numbers required to run.
If Apter cancels an in-person course because it has not reached sufficient enrolment, each participant may choose to transfer to the next available in-person cohort, convert to an available online version with any price difference refunded, or receive a full refund of the course fee to the original payment method.
To the extent permitted by law, Apter is not responsible for external costs incurred by participants, including travel, accommodation or leave. Participants should not book non-refundable travel or accommodation until Apter confirms in writing that the course will proceed.
7. Online courses, recordings, and materials
Where a course includes online access, recordings, digital materials, templates, worksheets, or other resources, these are provided for the registered participant’s own professional learning.
Unless Apter states otherwise in writing:
• access is personal to the registered participant;
• access may not be shared with others;
• recordings may not be downloaded, copied, published, or redistributed;
• materials may not be resold, repackaged, or used to deliver competing training;
• access periods may be limited.
Apter may remove or change online materials where necessary.
8. Participant conduct
Participants are expected to behave professionally and respectfully toward facilitators, speakers, staff, venue personnel, and other participants.
Apter may remove a participant from a course without refund if they:
• behave abusively, unlawfully, disruptively, or unsafely;
• harass or discriminate against others;
• misuse course materials or confidential information;
• breach venue rules or reasonable instructions;
• materially breach these Terms.
9. Intellectual property
All Apter website content, course materials, slides, recordings, exercises, frameworks, templates, graphics, written content, branding, and related materials are owned by Apter or used by Apter with permission.
You may use course materials for your own professional learning and internal work purposes.
You must not copy, publish, sell, license, distribute, upload, train AI systems on, or create derivative commercial products from Apter materials without written permission.
Where a speaker, guest lecturer, partner, or participant contributes material, their rights remain with them unless otherwise agreed.
10. Practitioner Award, scholarships, and funded places
Apter may offer Practitioner Awards, scholarships, funded places, discounts, travel support, or other access initiatives from time to time.
Unless stated otherwise, these opportunities are skill-based and are not random prize draws.
Award or scholarship terms may include eligibility criteria, application questions, judging criteria, closing dates, included and excluded costs, notification dates, and recipient obligations.
No purchase or paid registration is required to apply unless the specific terms say otherwise.
Where an award includes travel or accommodation, Apter may book and pay suppliers directly. Unless stated otherwise, awards do not include side travel, plus-ones, personal expenses, time off work, insurance, meals beyond what is specified, or costs not expressly included.
If the relevant course does not go ahead, Apter may transfer the award to a future course, future cohort, or another suitable Apter course year, rather than paying the award as cash.
Apter may decline, withdraw, transfer, or reallocate an award if:
• an applicant provides false or misleading information;
• the recipient cannot attend the relevant course;
• the recipient does not respond within the required time;
• eligibility criteria are not met;
• the relevant course is cancelled, postponed, rescheduled, or materially changed;
• continuing with the award would be unlawful, unsafe, or impractical.
If a paid participant is later selected for an award that covers their course place, Apter may refund, credit, or convert the registration as appropriate.
Specific award terms should be read together with these Terms. If there is an inconsistency, the specific award terms apply to that award.
11. Email, newsletters, and marketing communications
You may receive emails from Apter if you register for a course, enquire about a course, apply for an award, subscribe to a newsletter, have an existing relationship with Apter or its course programs, or otherwise engage with us.
Our communications may include course information, event updates, professional development opportunities, newsletters, award announcements, and related content.
You can opt out of marketing communications at any time by using the unsubscribe option where available or by contacting us.
We may still send administrative or transactional messages, including registration confirmations, invoices, course logistics, policy updates, and direct replies to enquiries.
12. Privacy
Apter collects and uses personal information to operate the website, manage course registrations, communicate with participants, process payments and invoices, assess award applications, deliver courses, and improve our services.
We may collect information such as your name, organisation, role, contact details, billing details, dietary or accessibility needs, course preferences, application responses, and communication history.
Apter should maintain a separate Privacy Policy explaining how personal information is collected, used, stored, and disclosed. Once available, the Privacy Policy should be read together with these Terms.
We do not sell personal information.
13. Third-party services
Apter may use third-party services for website hosting, registration, payments, invoicing, email, analytics, customer relationship management, video conferencing, course delivery, and other operations.
These services may have their own terms and privacy practices.
Apter is not responsible for third-party systems except to the extent required by law.
14. Disclaimers
Apter courses and materials are provided for professional development and general educational purposes.
They do not constitute legal, financial, engineering, planning, safety, procurement, medical, or other professional advice tailored to your specific circumstances.
You are responsible for applying your own professional judgment and seeking specialist advice where needed.
While Apter aims to provide high-quality, current, and practical content, we do not guarantee that any course, material, or communication will produce a particular employment, business, regulatory, project, procurement, or professional outcome.
15. Limitation of liability
To the maximum extent permitted by law, Apter is not liable for indirect, consequential, incidental, special, or economic loss, including lost profits, lost opportunities, travel costs, accommodation costs, lost data, business interruption, or reputational harm.
Where Apter is liable and the law permits us to limit that liability, our liability is limited to one or more of the following, at our option:
• resupplying the relevant service;
• paying the cost of resupplying the relevant service;
• refunding the amount paid to Apter for the relevant service.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under Australian law.
16. Force majeure
Apter is not responsible for delay, cancellation, non-performance, or changes caused by events beyond our reasonable control, including severe weather, natural hazards, illness, venue closure, travel disruption, government action, industrial action, technology failure, pandemic, emergency, or speaker unavailability.
Where such an event affects a course, Apter will take reasonable steps to reschedule, transfer, credit, refund, or otherwise manage the situation fairly.
17. Changes to these Terms
Apter may update these Terms from time to time.
The updated version will apply from the date it is published on the website, unless stated otherwise.
For existing course registrations, the Terms in place at the time of registration will generally apply unless a change is required by law or is clearly administrative.
18. Governing law
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the courts of New South Wales and any courts entitled to hear appeals from those courts.
